Philadelphia mortgage company settles redlining suit

A mortgage company has agreed to pay more than $20 million to settle claims it engaged in redlining in Philadelphia, neighboring Camden, N.J., and Wilmington, Del.

 

Trident Mortgage Co., owned by Berkshire Hathaway Inc., reached the settlement with the Department of Justice, the Consumer Financial Protection Bureau and the Pennsylvania, New Jersey and Delaware attorney generals.

Judge: Terms of trial loan modification ‘misleading’

A New Jersey man was granted a trial modification on his mortgage loan. The modification specified terms of payment during the modification and after it was successfully completed. 


After the man successfully completed the trial modification, the servicer offered terms of payment that were different than those previously agreed upon. 


The man sued, alleging breach of covenant of good faith and violations of RESPA. The servicer sought to dismiss the action.


 
FHFA proposes housing goals for Freddie, Fannie

The Federal Housing Finance Agency (FHFA) recently proposed new benchmark levels for the multifamily housing goals for Fannie Mae and Freddie Mac for 2023 and 2024.

FHFA said it is not proposing any changes to the underlying criteria that determine which multifamily units qualify for credit under the housing goals in this proposed rule.

FTC reimbursing consumers scammed by debt collection scheme

The Federal Trade Commission recently announced it is sending payments totaling more than $1 million to 1,966 consumers who were harmed by a debt collection scheme that conned consumers into paying debts they did not owe.

 

The agency said the defendants which perpetuated the scheme used several names, including GAFS Group, Global Mediation Group and Mediation Services.

Report links housing justice with gender justice

The National Women’s Law Center, in collaboration with the Insight Center and Groundwork Collaborative, recently released a report examining the links between housing justice and gender justice and outlining solutions to advance housing as a public good.

Existing-homes sales continue to drop

Existing-home sales declined for the sixth straight month in July, with all major regions experiencing month-over-month and year-over-year decreases, according to the National Association of Realtors (NAR).

 

NAR Chief Economist Lawrence Yun said the ongoing sales decline reflects the impact of the mortgage rate peak of 6 percent in early June.

Judge allows complaint against AmeriHome to proceed

The holder of a Maryland woman’s mortgage note was supposed to use a portion of her monthly payment to pay homeowners insurance to a separate company.

The mortgage holder never made the payments, and then placed an insurance policy on her property. On other occasions, mortgagee made payments over the telephone and was told convenience fees would be added for telephone payment.

The woman sued.

 
Multi-state lawsuit filed against Mariner Finance

A multi-state lawsuit has been filed against Maryland-based Mariner Finance for alleged widespread violation of consumer protection laws, including adding costly, hidden “add-on” products such as credit insurance to the loans of consumers who never agreed to purchase them.

 

The lawsuit alleges Mariner took advantage of consumers with limited access to credit who were already struggling with debt, and who had few or no other options available to obtain personal loans.

FHFA to require more fair lending data collection

The Federal Housing Finance Agency (FHFA) today announced that Fannie Mae and Freddie Mac will require servicers to obtain and maintain fair lending data on their loans, and for this data to transfer with servicing throughout the mortgage term.

Sen. Sherrod Brown (D-Ohio), chairman of the Senate Committee on Banking, Housing, and Urban Affairs, praised FHFA’s announcement.

HUD earmarks millions for affordable housing in Cincinnati

The U.S. Department of Housing and Urban Development (HUD) announced a $34 million loan guarantee for Cincinnati, Ohio for the Affordable Housing Loan Fund Project to spur the creation of more affordable housing.


With the assist from HUD, the city hopes to be able to drive private investment, add housing units throughout the city, eliminate concentrations of poverty and allow developers to take on projects with greater financing risks in marginalized neighborhoods.

Housing group urges Congress to address housing-equity issues

While praising the passage of the Inflation Reduction Act of 2022, the National Fair Housing Alliance is urging Congress to focus on housing as a key driver of inflation to create equitable opportunities for communities of color and rural parts of the nation.

Bank’s decision to withdraw payment from separate account affirmed
Posted Date: Monday, August 15, 2022
A Maryland man took out a home equity line of credit (HELOC). The man later opened a deposit account with the same bank which held his HELOC.

When the man failed to make required payments on the HELOC, the bank withdrew the payments from his deposit account. 

The man sued the bank, claiming the unauthorized withdrawals caused him economic damages.


 
CFPB: Financial companies must safeguard consumer data

In a recently published circular, the Consumer Financial Protection Bureau confirmed that financial companies may violate federal consumer financial protection law if they fail to safeguard consumer data.

 

The bureau said the circular is intended to provide guidance to consumer protection enforcers, including examples of when firms can be held liable for lax data security protocols.

Democrats urge changes to CRA

Nearly 80 democratic members of the U.S. House of Representatives sent a letter to several federal agencies urging them to consider the concerns of civil rights and community groups as well as other stakeholders as they modernize the Community Reinvestment Act.

 

The letter was sent to the leaders of the Board of Governors of the Federal Reserve System, the Federal Deposit Insurance Corp., and Office of the Comptroller of the Currency.

California penalizes buy now, pay later company

The California Department of Financial Protection & Innovation (DFPI) has fined a Florida-based point-of-sale lender.


DFPI said buy now, pay later (BNPL) products are loans and that the companies that offer them must comply with California’s state lending rules.  In 2020, DFPI entered similar settlements with BNPL companies Quadpay, Sezzle, Afterpay US, and Klarna, Inc.

More markets experience double-digit price gains in second quarter

A greater number of markets experienced double-digit annual price gains compared to the prior quarter, according to the National Association of Realtors’ (NAR) latest quarterly report.

 

According to NAR, 80 percent of the 185 tracked metro areas posted double-digit price gains, up from 70 percent in the first quarter of this year.

Nationally, the median single-family existing-home price surpassed $400,000 for the first time.

Judge allows fraud case based on faulty disclosures to continue

A Pennsylvania homeowner claimed a bank gave her false or misleading information about estimated taxes and closing costs.

She relied on that information when accepting a loan offer. She later learned the actual estimated taxes and closing costs were significantly higher. However, at that point she was contractually obligated. She sued the bank for fraud/misrepresentation, negligent misrepresentation and violation of the Pennsylvania Unfair Trade Practices and Consumer Protection Law.

The bank asked a magistrate judge to dismiss the charges.

 
CFPB fines fintech for faulty algorithm

The Consumer Financial Protection Bureau (CFPB) fined a financial technology company for using a faulty algorithm that caused overdrafts and overdraft penalties for customers.

 

The bureau said Hello Digit, LLC’s product Hello Digit was meant to save people money. Instead, the company falsely guaranteed no overdrafts with its product, broke its promises to make amends for its mistakes and pocketed a portion of the interest that should have gone to consumers, according to the CFPB.

CFPB: Digital marketers must comply with consumer protections

The Consumer Financial Protection Bureau (CFPB) issued an interpretive rule explaining when digital marketing providers for financial firms must comply with federal consumer financial protection law.

California funds financial education and empowerment programs

The California Department of Financial Protection and Innovation recently awarded nearly $2 million in CalMoneySmart grants to nonprofit organizations in the state to support free financial education and empowerment programs.

Funded programs include web and classroom-based content and individualized coaching for unbanked and underbanked consumers. Grants were awarded to 12 nonprofits.

Bank correct in requiring ex-husband’s signature for loan modification

After defaulting on her mortgage loan, an Ohio woman attempted to get a loan modification. However, because her ex-husband’s name was listed on the mortgage he also needed to agree to the modification, even though he had no interest in the home. When the ex-husband refused to cooperate, no modification was offered. The woman sued the owner of the loan, which asked the court to dismiss the action.

Illinois city penalized for fair housing violation

A federal jury awarded $293,000 in damages against the city of Springfield, Ill. for attempting to close a group home for people with developmental disabilities.

According to the Department of Justice, in 2014 three residents with intellectual and physical disabilities moved into a single- family home in Springfield where they received community residential services from a state-licensed provider.

GAO asked to study housing insecurity among seniors

The chairwoman of the House Financial Services Committee is urging the Government Accountability Office (GAO) conduct a review of the risks seniors experiencing housing insecurity face and the federal programs that exist to prevent homelessness among this population.

 

In her letter to the GAO, Rep. Maxine Waters (D-Calif.) also requested the federal agency identify racial and ethnic disparities in its review.

Housing groups urge CRA changes

The National Fair Housing Alliance (NFHA) and nearly a dozen other advocacy groups submitted a comment letter to the Federal Reserve, the Federal Deposit Insurance Corp. and the Office of the Comptroller of the Currency in response to their joint Notice of Proposed Rulemaking to amend the regulations implementing the Community Reinvestment Act of 1977.

Appellate court rejects couple’s ‘end run’ around HBOR

A California couple sued CitiMortgage for failing to appoint an adequate single point of contact to handle their request for a modification of their home loan.

The couple sought damages and an injunction preventing non-judicial foreclosure pursuant to causes of action for negligence, unfair business practices and violations of the Homeowner Bill of Rights. 

The couple subsequently sought leave to file an amended complaint to allege a new claim for fraud. The trial court denied the couple’s leave to amend, and the couple appealed that decision.



 
FTC penalizes Opendoor $62 million for ‘deceptive’ tactics

The Federal Trade Commission issued an administrative order against online homebuying firm Opendoor Labs Inc. for allegedly cheating potential homesellers by tricking them into thinking that they could make more money selling their home to Opendoor than on the open market using the traditional sales process.

 

The agency said most people who sold to Opendoor made thousands of dollars less than they would have made selling their homes using the traditional process.

Housing groups urge judge not to dismiss BOA lawsuit

The National Fair Housing Alliance and 19 other fair housing groups urged a federal judge not to dismiss a lawsuit against Bank of America and its property maintenance vendor, Safeguard Properties Management, regarding property maintenance and marketing practices the groups consider racially discriminatory.

CFPB urged to increase data security for data aggregators

New Jersey borrower sues servicers for RESPA, RICO violations

A New Jersey homeowner attempting to overturn a state court ruling foreclosing on his home, claimed six defendants engaged in fraudulent and unconscionable practices, violated RESPA, were unjustly enriched and violated state and federal RICO statutes. CFPB penalizes ‘law-breaking’ bank

The Consumer Financial Protection Bureau recently penalized U.S. Bank $37.5 million for illegally accessing its customers’ credit reports and opening checking and savings accounts, credit cards and lines of credit without customers’ permission.

 

The bureau said U.S. Bank pressured and incentivized its employees to sell multiple products and services to its customers, including imposing sales goals as part of their employees’ job requirements.

Senators reintroduce banking anti-discrimination bill

A group of Democrats and one Independent have reintroduced a bill prohibiting banks and other financial institutions from discrimination in providing goods or services based on race, color, religion, national origin, sex, gender identity or sexual orientation.

The legislation would ensure that all people receive equal treatment when trying to access services at financial institutions and hold institutions accountable for discriminatory practices.

CFPB examines how consumer-reporting companies handle medical debt

The Consumer Financial Protection Bureau (CFPB) has published an analysis of how actions announced by the three largest national consumer-reporting companies–Experian, Equifax, and TransUnion–will affect people who have allegedly unpaid medical debt on their credit reports.

 

The bureau said nearly half of those with medical collections appearing on their credit reports will continue to see them there even after the changes fully go into effect next year.

NAR economist: No decline in home prices anticipated

The chief economist for the National Association of Realtors (NAR) told the U.S. Senate Committee on Banking, Housing and Urban Affairs he does not foresee a nationwide decline in home prices despite indications that price growth is set to slow.

 

Testifying before the Senate committee, Lawrence Yun said the potential for weaker sales should increase available inventory in some markets, but not enough to diminish persistent affordability constraints.

HUD awards funds to assist people with disabilities

CFPB penalizes automaker for credit-reporting problems

The Consumer Financial Protection Bureau (CFPB) penalized Hyundai Capital America for repeatedly providing inaccurate information to nationwide credit reporting companies and failing to take proper measures to address inaccurate information once it was identified.

 

According to the CFPB, between 2016 and 2020, Hyundai used manual and outdated systems, processes and procedures to furnish credit reporting information.

Banking group praises Biden move to fund affordable housing

Mortgage Bankers Association (MBA) President and CEO Bob Broeksmit is praising the Biden administration’s new guidance to increase the ability of state, local and tribal governments to use American Rescue Plan funds to expand the supply of affordable housing.

Broeksmit said MBA will examine the Treasury’s guidance in greater detail and looks forward to its ongoing work with the administration, Congress and industry stakeholders on safe-and-responsible policies.

12 USC Section 2605 or Section 6 is titled Servicing of mortgage loans and administration of escrow accounts. It pertains to qualified written requests, notices of transfer of servicing and the administration of escrow accounts.
An arrangement that involves a person who is in a position to refer business as part of a real estate settlement service and who has an interest in a settlement services provider.

In the arrangement, the person, who has either an affiliate relationship with or a direct or beneficial ownership interest of more than one percent in a settlement services provider, directly or indirectly refers business to that provider or influences a consumer to select that provider.
An arrangement that involves a person who is in a position to refer business as part of a real estate settlement service and who has an interest in a settlement services provider.

In the arrangement, the person, who has either an affiliate relationship with or a direct or beneficial ownership interest of more than one percent in a settlement services provider, directly or indirectly refers business to that provider or influences a consumer to select that provider.
A mortgage disclosure that lists all estimated charges and fees associated with your loan. In addition to fees and charges, it will list your loan amount, mortgage rate, loan term and estimated monthly payment. Your escrows due at closing for insurance and taxes will also be outlined. Mortgage lenders are legally required to provide a GFE within three days of receiving your application.
A mortgage disclosure that lists all estimated charges and fees associated with your loan. In addition to fees and charges, it will list your loan amount, mortgage rate, loan term and estimated monthly payment. Your escrows due at closing for insurance and taxes will also be outlined. Mortgage lenders are legally required to provide a GFE within three days of receiving your application.
Under RESPA Section 2605(e)(1)(B), a qualified written request is a written correspondence that includes: 1) the name and account of the borrower, or has enough information to allow the servicer identify that information; and 2) a statement of the reasons for the belief of the borrower that the account is in error or provides sufficient detail to the servicer regarding other information sought by the borrower.

A QWR cannot be written on a payment coupon or other payment medium supplied by the servicer.
Under RESPA Section 2605(e)(1)(B), a qualified written request is a written correspondence that includes: 1) the name and account of the borrower, or has enough information to allow the servicer identify that information; and 2) a statement of the reasons for the belief of the borrower that the account is in error or provides sufficient detail to the servicer regarding other information sought by the borrower.

12 USC Section 2609 or Section 10 is titled Limitation on requirement of advance deposits in escrow accounts. It governs escrow accounts including notifications and statements to borrowers. Section 10 also sets out penalties for those who violate the section.
RESPA Section 3 provides that a thing of value includes any payment, advance, funds, loan, service or other consideration

Regulation X says thing of value includes: monies, things, discounts, salaries, commissions, fees, duplicate payments of a charge, stock, dividends, distributions of partnership profits, franchise royalties, credits representing monies that may be paid at a future date, the opportunity to participate in a money-making program, retained or increased earnings, increased equity in a parent or subsidiary entity, special bank deposits or accounts, special or unusual banking terms, services of all types at special or free rates, sales or rentals at special prices or rates, lease or rental payments based in whole or in part on the amount of business referred, trips and payment of another person’s expenses or reduction in credit against an existing obligation.
A form used by a settlement or closing agent itemizing all charges imposed on a borrower and seller in a real estate transaction. This form represents the closing transaction and provides each party with a complete list of incoming and outgoing funds.
