Chase Bank did not violate RESPA or the Truth in Lending Act (TILA) when servicing an Alabama man’s mortgage and attempting to collect funds not owed.
However, Kenneth Wayne Rice’s amended complaint for libel alleging that foreclosure sale notices in his local newspaper were defamatory because he was not in default on his mortgage is allowed to proceed, a federal judge has ruled.
