Affiliated business arrangements (AfBAs), marketing and services agreements (MSA), desk rentals, Internet co-advertising and lead generation agreements are on the rise.
But the legal requirements for creating these arrangements are only the beginning. Title insurance underwriters and agents also must consider numerous other viable factors before deciding to delve into the strategic alliance pool.
Phil Schulman and Holly Spencer Bunting, partners at Mayer Brown, will be co-presenting the session “Practical Considerations for Title Agents Creating Strategic Alliances” Wednesday, June 19, at the 2019 National Settlement Services Summit (NS3) in Phoenix.
“Since the PHH decision came down favorably in the industry’s favor, and with the CFPB relaxing its enforcement activities, there has been an exponential increase in marketing and advertising activities,” Schulman said. “Title companies and other settlement service providers need to carefully consider participation before jumping into the deep end of the pool.”
