After a couple in Florida failed to block the foreclosure action against them in state court, and were unable to get the decision reversed on the appellate level, they turned to the U.S. District Court for the Middle District of Florida to rescind their loan, alleging violations of RESPA and the Florida Fair Debt Collection Practices Act. The judge, however, determined that the couple had already had their day in court.
