Bureau looks to reinstate penalty on appeal

In its latest briefing in an appeal before the Ninth Circuit Court of Appeals, the Consumer Financial Protection Bureau argued that the district court erred by not granting restitution in its decision in favor of the bureau against online lender CashCall.
The bureau’s brief not only addressed the restitution issue, but challenged a cross-appeal claim against its constitutionality – directly challenging then-judge Brett Kavanaugh’s dissent in PHH Corp. v. CFPB along the way.

AGs urge CFPB to reconsider no-action letter proposal

Twenty-two states attorney generals have asked the Consumer Financial Protection Bureau to reconsider and rescind its proposed policy on no-action letters and the plan to establish a regulatory sandbox to guard entities from liability.

CFPB releases FDCPA report

The Consumer Financial Protection Bureau has announced it will issue a notice of proposed rulemaking on debt collection to address issues ranging from communication practices to consumer disclosures.

NAFCU report: Credit union lending outperforms banks

Report: Lenders submitting lower-quality loans in competitive market

The third quarter of 2018 saw the second-highest defect level since the TRID rule went into effect in October 2015.
The critical defect rate reached 1.89 percent, increasing about 11 percent from the previous quarter’s 1.71 percent rate, according to a new report from ACES Risk Management (ARMCO).

HUD approves $8.2 billion Puerto Rico disaster recovery plan

A Massachusetts couple claimed their servicer failed to timely acknowledge and respond to a notice of error (NOE) after a foreclosure sale.
The servicer argued there was no private cause of action to sue for a RESPA violation, but the district court judge cited text from the Consumer Financial Protection Bureau to determine there was a private cause of action under § 1024.35.

OCC issues BSA order against MUFG Bank

The Office of the Comptroller of the Currency (OCC) announced a cease-and-desist order against the New York, Chicago and Los Angeles federal branches of MUFG Bank, Ltd., Tokyo, Japan, for violating the Bank Secrecy Act (BSA) and its underlying regulations.
The order stems originally from penalties brought in 2013 and 2014 by the New York Department of Financial Services against branches for BSA violations. The consent order issued by the OCC said it found those deficiencies, and others, at the bank dating back to 2016.

HUD names monitor for NY Housing Authority

Department of Housing and Urban Development Secretary Ben Carson announced that Bart Schwartz will be named to serve as a federal monitor to ensure the New York City Housing Authority satisfies the conditions of a recently announced agreement to correct chronically poor housing conditions endured by its residents.
Schwartz is the former head of the criminal division of the U.S. District Court for the Southern District of New York.

CUNA reaches out to new AG on ADA solution

Shortly after William Barr was confirmed as the new U.S. attorney general, the Credit Union National Association sent him a letter regarding how the Americans With Disabilities Act (ADA) applies to websites.
The issue has been at the forefront of advocacy for credit union trade associations, whose members have been battling hundreds of lawsuits accusing the credit unions of violating Title III of the ADA related to website compliance.
