In a case of first impression, a borrower obtained a loan to make repairs to a California property so that her niece, as the sole beneficiary of the trust, could continue to live there.
The borrower alleged the loan disclosures did not accurately reflect the terms of the loan. The lender argued rescission and damage remedies are available only in “consumer credit transactions.”
