A Florida borrower alleged her servicer’s motion to reschedule a previously ordered foreclosure sale – rather than cancel it altogether – violated loss mitigation procedures.
The U.S. District Court for the Southern District of Florida previously found no evidence the servicer moved for an order of foreclosure sale after the borrower submitted her complete loss mitigation application.
